Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Playlist Wall ("Playlist Wall," "we," "us," or "our") governing your use of the Playlist Wall website and application (the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Please read Sections 5, 9, 10, and 13 carefully. They describe how Playlist Wall changes your music library at your direction, disclaim warranties, limit our liability, and set out how disputes are handled.

1. The Service

Playlist Wall is an independent tool that helps you view and organize the music library in your own streaming account. It lets you play songs and file them into your playlists, create playlists, and add or remove tracks. Playlist Wall is not a music streaming service, does not host or provide any music, and is not affiliated with, endorsed by, or sponsored by Apple Inc., Spotify AB, or any other rights holder. You need your own active account and subscription with a supported service to use Playlist Wall.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country) and able to form a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms for it.

When you connect a music service, you authorize Playlist Wall to access and modify your library only as you direct, in order to perform the actions you request (such as adding a song to a playlist or removing one). You can withdraw this permission at any time by signing out or revoking access in your music service's settings.

5. Changes to your library, and your responsibility

Playlist Wall makes real changes to your own music library. When you add, remove, merge, or delete songs or playlists, those actions affect your actual account and may be difficult or impossible to undo. You are solely responsible for the actions you take and for reviewing them before you confirm. To the fullest extent permitted by law, Playlist Wall is not responsible for any change, loss, deletion, or unintended modification of your library, playlists, or data, whether caused by you, by the Service, by a third-party service, or otherwise. We recommend you understand an action before confirming it and keep your own records of anything important.

We may suspend or terminate access for conduct that violates these Terms or that we reasonably believe is harmful.

7. Intellectual property

The Service, including its software, design, branding, and the Playlist Wall name and logo, is owned by us and protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You retain all rights to your own content and music; nothing in these Terms transfers ownership of your data to us. You may not use our branding without permission.

8. Third-party services

The Service interoperates with third parties such as Apple Music and Spotify. Your use of those services is governed by their own terms and policies, which we do not control and are not responsible for. Apple Music and the Apple logo are trademarks of Apple Inc. Spotify is a trademark of Spotify AB.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, error-free, or that it will meet your requirements, or that any data or changes will be accurate or preserved. You use the Service at your own risk.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PLAYLIST WALL AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PLAYLISTS, MUSIC, PROFITS, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. To the extent any liability cannot be excluded, our total liability for all claims relating to the Service is limited to the greater of the amount you paid us to use the Service in the twelve months before the claim, or fifty U.S. dollars ($50). Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Playlist Wall and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these Terms or of any law or third-party right.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access at any time, with or without notice, including if we believe you have violated these Terms. Sections that by their nature should survive termination (including Sections 5, 7, 9, 10, 11, and 13) will survive.

13. Governing law and disputes

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. Before filing a claim, you agree to first contact us at support@playlistwall.app and try to resolve the dispute informally for at least 30 days. Any dispute that is not resolved will be brought exclusively in the state or federal courts located in California, and you consent to their jurisdiction. To the extent permitted by law, you and Playlist Wall agree that claims will be brought only in an individual capacity and not as part of any class or representative action.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.
